जल संसाधन विभाग बिहार सरकार द्वारा बिहार में कनीय अभियंताओं की नियुक्ति हेतु नियमावली बनायीं गयी है जिसे बिहार जल संसाधन विभाग, अवर अभियंत्रण ( असैनिक ) संवर्ग भर्ती ( संशोधन ) नियमावली, 2017 के नाम से जाना जाता है . इस नियमावली में बिहार जल संसाधन विभाग अवर अभियंत्रण ( असैनिक ) संवर्ग भर्ती नियमावली, 2015 के कुछ प्रावधानों में संशोधन किया गया है जिसे आप इस आर्टिकल में देख सकते है . इसे बिहार के राज्यपाल के आदेश से लागु किया है जिसे बिहार गज़ट 28 नवम्बर 2017 को प्रकाशित किया गया है . आप एअसके पीडीऍफ़ को निचे दिए गए लिंक के माध्यम से डाउनलोड भी कर सकते है .
सं0 9 / स्था0 – 11 – 1139 / 06 अंश – 1 – 3950 — भारत के संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल “बिहार जल संसाधन विभाग अवर अभियंत्रण ( असैनिक ) संवर्ग भर्ती नियमावली, 2015 ” का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैं :-
1. संक्षिप्त नाम , विस्तार एवं प्रारम्भ ।
(1) यह नियमावली “बिहार जल संसाधन विभाग, अवर अभियंत्रण ( असैनिक ) संवर्ग भर्ती ( संशोधन ) नियमावली, 2017 ” कही जा सकेगी ।
(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा ।
(3) यह तुरंत प्रवृत्त होगी ।
2. बिहार जल संसाधन विभाग अवर अभियंत्रण ( असैनिक) संवर्ग भर्ती नियमावली, 2015 के नियम – 5 का प्रतिस्थापन
– उक्त नियमावली, 2015 के नियम – 5 को निम्नलिखित द्वारा प्रतिस्थापित किया जाता है :
” 5. आरक्षण: –
बिहार पदों एवं सेवाओं की रिक्तियों में आरक्षण ( अनुसूचित जातियों, अनुसूचित जनजातियों एवं अन्य पिछड़े वर्गों के लिए ) अधिनियम – 1991 ( अधिनियम – 3, 1992 ) ( समय – समय पर यथा संशोधित ) एवं उसके अधीन बनायी गयी नियमावली के प्रावधान एवं संकल्प सं0 – 963 दिनांक 20.01.16 द्वारा यथा विहित महिलाओं के लिये क्षैतिज आरक्षण के प्रावधान तथा राज्य सरकार द्वारा समय – समय पर यथा विहित रोस्टर एवं आरक्षण के प्रावधान नियुक्ति में लागू रहेंगे । ”
3. बिहार जल संसाधन विभाग अवर अभियंत्रण ( असैनिक ) संवर्ग भर्ती नियमावली, 2015 के नियम – 9 (1) (iii ) का प्रतिस्थापन ।
उक्त नियमावली , 2015 के नियम – 9(1 )(iii ) को निम्नलिखित द्वारा प्रतिस्थापित किया जाता है :
” 9 (1) (iii ) चयन हेतु तकनीकी योग्यता / अहर्ता :
( क ) अखिल भारतीय तकनीकी शिक्षा परिषद् नई दिल्ली से मान्यता प्राप्त संस्थानों के असैनिक अभियंत्रण ( Civil Engineering ) के डिप्लोमाधारी जिन्हें संबंधित तकनीकी शिक्षा पर्षद / विश्वविद्यालय के द्वारा डिप्लोमा प्रदत्त हो ,
अथवा
( ख ) UGC Act के प्रावधानों के अन्तर्गत स्थापित DEEMED University द्वारा Non- Distance Mode में असैनिक अभियंत्रण में प्रदत्त डिप्लोमा बशर्ते कि उक्त DEEMED University को असैनिक अभियंत्रण ( Civil Engineering ) में डिप्लोमा पाठ्यक्रम करने के लिए विश्वविद्यालय
अनुदान आयोग की स्वीकृति प्राप्त हो ।
4. बिहार जल संसाधन विभाग अवर अभियंत्रण ( असैनिक ) संवर्ग भर्ती नियमावली, 2015 के नियम – 10 का प्रतिस्थापन ।
उक्त नियमावली, 2015 के नियम – 10 को निम्नलिखित द्वारा प्रतिस्थापित किया जाता है :
” 10. चयन की प्रक्रिया ( 1) इस संवर्ग के मूल कोटि कनीय अभियंता ( असैनिक ) के पदों पर चयन डिप्लोमा अथवा समकक्ष योग्यता में प्रतिशत प्राप्तांक के आधार पर आयोग द्वारा किया जायेगा । बिहार सरकार या बिहार सरकार के अधीन किसी उपक्रम / निगम / निकाय / प्राधिकार / स्वशासी निकाय में संविदा के आधार पर कनीय अभियंता ( असैनिक ) के पद पर कार्य करने का अनुभव रखने वाले अभ्यर्थी, जो इस संवर्ग में भर्ती की अहर्ता पूरी करते हैं , को चयन में इस नियम के उप नियम – (2 ) ( ख ) के अनुसार अतिरिक्त अंक देकर अधिमानता दी जाएगी ।
( 2 ) अभ्यर्थियों की मेधा सूची निम्नलिखित आधार पर तैयार की जाएगी :

| (ख ) संविदा के आधार पर कार्य करने के निमित्त अधिकतम अधिमानता ( प्रति कार्यरत वर्ष के लिए 5 अंक जिसकी अधिकतम सीमा 25 अंक की होगी । किसी वर्ष के अंश के लिए कार्यरत दिवसों की संख्या में संख्या 5 से गुणा करने के पश्चात् 365 से भाग देकर प्राप्त अनुपातिक अंक जोड़ा जाएगा ) । | – 25 अंक |
| कुल – 100 अंक |
(3 ) संविदा के आधार पर कार्यरत अवधि का विनिश्चय संबंधित नियंत्री पदाधिकारी द्वारा निर्गत वेतन भुगतान प्रमाण – पत्र के आधार पर किया जाएगा । इस हेतु आयोग द्वारा प्रकाशित विज्ञापन में अंकित कट – ऑफ डेट की अवधि तक की गणना कार्य अनुभव के लिए की जा सकेगी ।
(4) असैनिक डिप्लोमाधारी उम्मीदवारों की कनीय अभियंता ( असैनिक ) के रूप में नियुक्ति निम्नलिखित रीति से की जाएगी :
( क ) बिहार जल संसाधन विभाग अवर अभियंत्रण ( असैनिक ) संवर्ग भर्ती नियमावली, 2015 के नियम – 5 के तहत कुल रिक्त पदों का आरक्षण कोटिवार 40 प्रतिशत पद राज्य के अधीन सरकारी पोलिटेक्निक संस्थानों से असैनिक डिप्लोमाधारी उम्मीदवारों के लिए आरक्षित रहेगी जिन्हें आरक्षण कोटिवार उपरोक्त नियम – 10 ( 2 ) के द्वारा निर्धारित प्रक्रिया के तहत तैयार मेधा सूची के आधार पर भरा जायेगा ।
(ख ) शेष रिक्ति आरक्षण कोटिवार बिहार जल संसाधन विभाग अवर अभियंत्रण ( असैनिक ) संवर्ग भर्ती नियमावली, 2015 के नियम – 9 ( 1 ) ( iii ) द्वारा निर्धारित योग्यता / अहर्ता के आधार पर नियम – 10 ( 2 ) में निर्धारित प्रक्रिया के तहत तैयार मेधा सूची के आधार पर की जाएगी ।
( ग ) कंडिका – ( ख ) के रिक्त पदों के सामान्य प्रक्रिया से भरे जाने के पश्चात् अवशेष मेधा सूची के आधार पर कंडिका – ( क ) के आरक्षित पदों को राज्य के अधीन सरकारी पोलिटेक्निक से उत्तीर्ण अभ्यर्थियों में से आरक्षण कोटिवार मेधा क्रम में चयन द्वारा भरा जाएगा ।
5. बिहार जल संसाधन विभाग , अवर अभियंत्रण ( असैनिक ) संवर्ग भर्ती नियमावली, 2015 का नियम – 11 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :
” 11 आयोग द्वारा नियम – 10 के अनसार चयनित उम्मीदवारों की अंतिम मेघा सची तैयार की जाएगी एवं उसे सरकार को नियुक्ति हेतु अनुशंसित की जाएगी । आयोग द्वारा अनुशंसित उम्मीदवारों का पैनल एक वर्ष के लिए वैध होगा । ”

सं0 9 / स्था0 – 11 – 1139 / 2006 अंश – 1 – 3950 “बिहार जल संसाधन विभाग, अवर अभियंत्रण ( असैनिक ) संवर्ग भर्ती (संशोधन ) नियमावली, 2017 ” का अंग्रेजी में निम्नलिखित अनुवाद बिहार राज्यपाल के प्राधिकार से एतद् प्रकाशित किया जाता है जो भारत संविधान के अनुच्छेद 348 के खण्ड ( 3 ) के अधीन अंग्रेजी भाषा मे उसका प्राधिकृत पाठ समझा जाएगा ।
No. 9 /Est – 11- 39/2006 Part-I -3950 — In exercise of the powers conferred under the proviso to Article – 309 of the Constitution of India , the Governor of Bihar is hereby pleased to make the following Rules to amend the Bihar Water Resources Department Subordinate Engineering (Civil ) cadre Recruitment Rules, 2015 ” :
Part – I
1 . Short title , extent and commencement
(1) These Rules may be called the ” Bihar Water Resources Department Subordinate Engineering (Civil) cadre Recruitment (amendment) Rules – 2017 ” :
(2 ) It shall extend to the whole of the State of Bihar.
(3 ) It shall come in force at once .
2 . Substitution of Rule -5 of Bihar Water Resources Department Subordinate Engineering (Civil ) cadre Recruitment Rules , 2015 :- Rules -5 of the said Rules, 2015 shall be substituted by the following :
” 5 . Reservation — The provisions of the Bihar Reservation of vaccancies in posts
and services (for Scheduled Casts , Scheduled Tribes and other Backward classes ) Act- 1991 ( Act – 3 , 1992 ) (as amended from time to time) and the Rules made there under and the horizantal reservation for women issued by resolution No.- 963 date 20 -01- 2016 and the roaster and reservation as prescribed by the State Government, from time to time, shall be applicable to the appointment in this cadre .
3 . Substitution of Rule – 9 ( 1) (iii) of Bihar Water Resources Department Subordinate Engineering (Civil) cadre Recruitment Rules, 2015 :- Rule -9 (1 ) ( iii ) of the said Rules, 2015 shall be substituted by the following :
” 9 ( 1 ) ( iii) — Technical qualification / eligibilities for selection :
(a ) Diploma holder in Civil Engineering from the institutes recognized by AICTE ,
which has obtained diploma from AICTE /University ,
OR
(b ) Diploma in Civil Engineering by Non -Distance Mode Diploma from Deemed University established under UGC Act provided that their syllabus of diploma in Civil Engineering has been sanctioned by UGC .
” 10 . Procedure of selection — ( 1) Selection to the posts of basic category of Junior Engineer (Civil) of this cadre shall be made by the Commission on the basis of percentage of marks obtained in Diploma or equivalent qualification . Such candidates having experience of working on the post of Junior Engineer (Civil) on contract basis under the Government of Bihar or in any Undertaking Corporation / Body/ Authority/ Autonomous Body under the Government of Bihar, who fulfill the qualifications of the recruitment in this cadre, shall be given preference by giving additional marks according to sub rule (2 ) (b ) of this Rule .
(2) Merit list of candidates shall be prepared on the following grounds :

(3 ) Determination of working period on the contract basis shall be made on the basis of Payment Certificate issued by their respective Controllig Officers. For this, the period up to the cut- off date mentioned in the advertisement published by the Commission may be calculated for the working experience .
(4 ) Appointment of the Civil Diploma holding candidates as Junior Engineer ( civil ) shall be made in the following manner

( a ) As per Rule -5 of Bihar Water Resources Department Subordinate Engineering (Civil ) Cadre Recruitment Rules, 2015 , 40 % seats of total vacant posts shall be reserved for the candidates holding Civil Diploma from the Government Polytechnic Institutes under the state as per category wise reservation merit list. Merit list will be prepared as per established norms mentioned above vide
Rule 10 (2 ).
(b ) Remaining vacant post shall be filled by merit list prepared as per norms mentioned above in Rule 10 (2 ) from the candidates holding the qualification leligibilities mentioned in Rule -9 (1) (iii ) of Bihar Water Resources Department
Subordinate Engineering (Civil ) Cadre Recruitment Rules, 2015 as per category wise reservation merit list.
After filling vacant posts of para (b ) through general procedure , the reserved posts of para (a ) will be filled from the remaining merit list on the basis of category wise merit of candidates passing from the Government Polytechnics of the state.
3. Rule – 11 of Bihar Water Resources Department Subordinate Engineering (Civil ) Cadre Recruitment Rules, 2015 shall be substituted by the follwoing :
” 11 . The Commission shall prepare final merit list of selected candidates accoding to Rule – 10 and shall recommend to the Government for appointment. The panel of candidates recommended by the Commission shall be valid for one year.”
